Subject: Code of Conduct Concern ------------------------ From: conductadmin@wgu.edu <conductadmin@wgu.edu> Date: Wed, Jun 18, 2014 at 3:00 PM To: "axxxxx@my.wgu.edu" <axxxxx@my.wgu.edu> Cc: "joi.stirrup@wgu.edu" <joi.stirrup@wgu.edu>
Dear Mr. xxxxx,
My name is Kumar Pandya and I serve as the student conduct officer at WGU. Part of my role is to help WGU students understand and develop appropriate professional behavior consistent with the Code of Conduct. WGU considers its students to be emerging professionals who are seeking intellectual and personal growth to meet career demands. WGU therefore deems it important that students find opportunities to safely interact with other WGU students, mentors, staff members and vendors to develop the skills and attitudes expected in the workplace. Some concerns have emerged regarding recent interactions with your former mentor that did not meet the level of professionalism expected of our students. You can review the WGU Code of Student Conduct through the following link: http://sh.wgu.edu/articles/ I need to discuss this matter with you, so please let me know when you would like to schedule a meeting (provide two days and times) and the number you would like me to call. Sincerely, Kumar Pandya Student Conduct Officer Western Governors University Toll-Free: 877.435.7948 x5387 Direct: 801.428.5387 kpandya@wgu.edu

"...former mentor that did not meet the level of
professionalism expected of our students."
I HAVE DONE NOTHING
WRONG!!!!!!!!!!!!!!!!!!!!!!!!!
I INSIST AND
REPEAT!! I HAVE DONE NOTHING
WRONG!!!!!!!!!!!!!!!
"...considers its students to be emerging
professionals who are seeking intellectual and
personal growth to meet career demands." How
are you expecting to accomplish this?...if you
and your staff don't follow these yourself? It
is quite simple, you cannot teach others what
you don't follow and what you don't know. If
your professionals are not conducting themselves
in a professional manner, then you have no
business teaching others to be professional!!!!
Your staff member Mike called me lazy and I told
him and I tell you: that is inappropriate and
extremely unprofessional! I didn't keep quiet
and made sure Mike (via email only) knew that I
was not content with his unprofessional manner.
He replied to the email stating that he did not
call me lazy but that he said I lacked
motivation. I could probably come up with 1,000
ways to call a student lazy and I could also
come up with 1,000 ways to call someone stupid,
without actually saying the word.
By sending me an
email and trying to discipline me for something
that I did not do, further victimizes me and
shows further disrespect for me and as I
adamantly stress out and will keep stressing
out: I HAVE ZERO TOLERANCE FOR DISRESPECT FROM
ANYONE!!!!!!!!!!!!!! My exclamation marks
should show you how agitated you have made me
with your further lack of disrespect by sending
me this foolish email!!!!!
What I expect
from you and your university is a letter of
apology and not a letter telling me that I was
sent to the principle's office!!! I will give
you a second chance sir to redeem yourself, and
wait for you to take the right path. YOU SEND ME
THAT LETTER OF APOLOGY!!!!

Hello Mr. xxxxx,
I'm sorry to hear that you are so upset, and I would be more than happy to discuss the situation with you and hear your side of the events, but your email to me is a perfect example of the behavior that needs to be addressed. Let me know when you will be available for a meeting. Regards, Kumar Pandya Student Conduct Officer Western Governors
University
My email to you was perfect. I am letting you know
exactly how you are not to treat your students. I
HOPE YOU WILL COMPLY WITH THE APOLOGY REQUESTED. You
should apologize for Mike's behavior and now also
for the email you sent me. I don't want to hear
anything more until you do. There IS absolutely no
reason for you to have sent me an email of any sort
in the first place. ...And if there was, it was
supposed to be an apology for Mike's behavior. I am
an adult and I demand that you treat me like
one!!!!!!!! Oh was that too loud? I hope I am loud
and clear that you can hear me. Disrespect deserves
disrespect and I have not started disrespecting
anyone yet. All I have done thus far is demand basic
respect; which is something to which your staff does
not know how to provide. I am not going to tolerate
any disrespect from anyone and if you are going to
have the nerve to disrespect me as if I was a third
grader in elementary school, then you don't have
anything to complain about. I suggest you take this
issue with your superiors so they can help you see
how wrong it was for you to tell me that you are
trying to discipline me.
WHEN YOU ARE READY TO APOLOGIZE THEN SEND ME
ANOTHER EMAIL. UNTIL THEN, PLEASE KEEP YOUR
EMAILS TO YOURSELF!!!!
...And if you are not willing to comply then let
me know if I have to speak to an attorney to
force you to stop the harassment. Maybe we can
let a judge decide if it is acceptable for you
and your staff to disrespect and harass your
customers the way you have been doing with me. I
thought this nightmare was over a while back. I
am not about to be caught up in it again. You
stop now or I will seek help to make you stop! I
have school and work to take care of and quite
honestly, I don't have time, that much time to
be wasting on you or Mike.

Dear Mr. xxxxx,
I understand that you feel your conduct has been acceptable, however, we strongly disagree, and the matter will be addressed further regardless of your participation. These actions are part of the educational process that you agreed to when enrolling at WGU, and in no way constitute harrassment. I would like to give you the opportunity to work with me toward a mutually agreeable resolution, but if you are unwilling to do so we can certainly proceed with further disciplinary action instead, as there is ample evidence of misconduct on your part. An administrative hold has been placed on your account and you will not be allowed to set term enrollment for the new term until your conduct issues have been resolved to our satisfaction, so it is imperative that you reconsider your position and cooperate with our efforts to remedy the problem if you wish to remain enrolled at WGU.
Regards,
Kumar Pandya From: axxxxx@my.wgu.edu [axxxxx@my.wgu.edu]

Ok. Actually I have been trying to contact you.

I have worked really hard to complete the units that
I have completed thus far. I also have spend a lot
of time on the finance class that is pending. It
would be devastating for me to just lose what I have
worked for. I am trying to figure out what it is
that I have done that is so wrong to have my
education frozen like this. Please provide a list of
the items, so I can work on them by the time I meet
with you. Thank you.

Hello Mr. xxxxx,
I'm sorry that I wasn't available to take your call this evening. I will be leaving the office shortly, but I have an opening in my schedule tomorrow morning at 11am MT (10am PT). If this is not a convenient time for you to talk, please let me know of an alternate time/day that will work better. I want to assure you that my intention is entirely to help you resolve these issues and move forward with your coursework. The referenced concerns are regarding your continued difficulties communicating professionally and productively with WGU staff, and nearly constant accusations of being disrespected by staff members who have done nothing more than attempt to assist you in accordance with their job duties. I look forward to speaking with you, and to a speedy and positive resolution to this matter. Regards, Kumar Pandya Student Conduct Officer

Also wanted to comment that I have been worried all
weekend. Especially since Joi had told me on our
last meeting that she was going to post the new
courses for me to start. I have been contacting the
university since yesterday. I was put on hold for a
very long time and I did not get an answer. I
contacted them today again and I especially was
worried without been able to do my work for my job,
work for which I have a deadline. I contacted the
university today and the lady was not able to give
me an answer as far as what was going on. She
transferred me to a supervisor and the man was not
able to give an answer either. Since today is
officially the start of my new semester, I
definitely extremely worried and knew something was
wrong. This is what shows when I go online to WGU: You
have no Courses at this time
Completed Courses!
No completed courses in this term
You have confirmed in your last email to me that
indeed something is wrong and that a freeze has
been place on my education and I will not be
able to continue until I comply with your
meeting request.
I have spent the last 40 minutes reading your
code of conduct. I have been trying to find the
section where it states that the university can
freeze an accused student from continuing with
his education before being found guilty. Can you
please show me where I can find this information
on the student code of conduct or the
university's policy?
I do see where it shows the outcomes and the 5
day process and the possible punishment upon
finding the student guilty of misconduct.
However, nowhere do I find that any action can
be taken on an accused student before being
found guilty of misconduct.
Please excuse my response to your wanting to
meet with me. I did not know that not wanting to
meet was such a huge conduct issue. As I
mentioned on the previous email, I have tried to
contact you but I failed to leave a message. I
tried at least 2 times yesterday and today. I
have been pressed for time as I have spent the
last 3 weeks dedicated to my quantitative
analysis class and have not put any time into my
job and things at work have become extremely
critical. Things need to be completed in the
next week or otherwise I will encounter problems
there.
I do need the process with this issue at the
university to be fair though and I do need the
information requested both here and in the
previous emails. It would be great if you can
please accommodate me with the requested
information so I can be prepared for our
meeting.
Thank you.
